Lawyers of Strategic Advocacy successfully defended the rights of a client against whom the Strategic Investigations Department of the Kyiv Region of the Strategic Investigations Department of the National Police of Ukraine had drawn up a report on an administrative offense under Part 1 of Article 172-6 of the Code of Administrative Offenses related to corruption under the Law of Ukraine “On Prevention of Corruption” for late submission of a declaration by a person authorized to submit it. 172-6 of the Code of Administrative Offenses, related to corruption under the Law of Ukraine “On Prevention of Corruption” for late submission of a declaration by a person authorized to perform functions of the state or local self-government.
During the court proceedings, the defense attorneys proved that the declaration was submitted late by the declarant for valid reasons, which excludes administrative liability under this report.
Having examined the evidence submitted by the lawyers of Strategic Advocacy Law Firm and the explanations provided at the court hearing, the court, based on the results of the case review, concluded that there was no proof of intent (direct or indirect) to submit a declaration late without valid reasons upon the dismissal of a person authorized to perform state or local self-government functions for a period not covered by previously submitted declarations; moreover, there were valid reasons for submitting such a declaration later.
