The court concluded that even minimal physical contact of a sexual nature without voluntary consent may constitute a violation of a person’s right to sexual freedom, regardless of the absence of violence or threats.

In light of this, the question arises: how are such actions classified in Ukraine, and what liability is provided for under national law?

Regulatory Framework in Ukraine

Under Ukrainian law, the issue of sexual violence is regulated, in particular, by Article 153 of the Criminal Code of Ukraine. According to its provisions, any acts of a sexual nature not involving penetration of another person’s body, committed without the victim’s voluntary consent, are considered criminal offenses.

The key element of such a criminal offense is precisely the absence of voluntary consent. At the same time, the law does not require the mandatory presence of physical violence, threats, or the exploitation of the victim’s vulnerable state—it is sufficient to establish the fact that acts of a sexual nature were committed without consent.

Assessment of such actions in legal practice

The classification of a specific act depends on the actual circumstances of the case. In cases where physical contact (such as kissing a hand) is accompanied by obvious sexual undertones, intrusive actions, or propositions of an intimate nature, such actions may be considered sexual assault.

At the same time, if there are no signs of a sexual nature and the behavior does not go beyond a disturbance of public order, the provisions of administrative law may apply, particularly regarding petty hooliganism.

Thus, the following factors are of decisive importance:

  • the nature of the actions;
  • the presence or absence of sexual undertones;
  • the individual’s behavior before, during, and after the contact;
  • the victim’s perception of the situation.

Types of Liability

Sexual assault (Article 153 of the Criminal Code of Ukraine) is punishable by imprisonment for up to five years. In the presence of aggravating circumstances, the penalty may range from three to seven years of imprisonment, and in cases of serious consequences—up to fifteen years.

In cases where the actions do not constitute a criminal offense but violate public order or a person’s personal boundaries, administrative liability may apply.

The significance of consent as a key legal criterion

Contemporary legal doctrine, both in Ukraine and in European countries, increasingly emphasizes the principle of voluntary consent as the defining criterion for assessing the legality of conduct in the sphere of interpersonal relations.

Any physical contact of a potentially sexual nature that occurs without consent may be considered a violation of a person’s right to sexual freedom and integrity.

The Spanish court’s decision reflects a general trend toward strengthening the protection of personal boundaries and human rights. Ukrainian law also contains provisions that allow such actions to be classified as offenses, depending on their nature and the circumstances under which they were committed.

Thus, even actions that have traditionally been perceived as socially acceptable may, under certain conditions, receive a different legal assessment.
